Posting any franchise, pyramid scheme, multi-level marketing, "club membership", distributorship or sales representative agency arrangement or other business opportunities which requires an up front or periodic payment, pays commissions only, requires recruitment of other members, sub-distributors or sub-agents, or other commercial venture.

Attempting to gather or solicit other user’s information for any reason not authorized by Cyber Junky, Inc.

Deleting or revising any material posted by any other person or entity. This includes, but is not limited to, the infringement of any third party’s content or transmission.

Using any device, software or routine to interfere or attempt to interfere with the proper working of this Web Site or any activity being conducted on this site.

Taking any action that imposes an unreasonable or disproportionately large load on this Web Site’s infrastructure.

If you have a password allowing access to a non-public area of this Web Site, disclosing to or sharing your password with any third parties or using your password for any unauthorized purpose.

Notwithstanding anything to the contrary contained herein, using or attempting to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search this Web Site other than the search engine and search agents available from Cyber Junky, Inc. on this Web Site and other than generally available third party web browsers, such as Netscape Navigator and Microsoft Explorer.

Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Web Site.

Aggregating, copying or duplicating in any manner any of the materials or information available from the Web Site.

Framing of or linking to any of the materials or information available from the Web Site.

Violate any other posted policy in regards to the use of this Web Site, regardless as to where the policy is located at on the Web Site.

Cyber Junky, Inc. has a right to refuse to post any message or other postings (if ever applicable) if they believes it is in violation of these terms and conditions. Cyber Junky, Inc. also reserves the right to terminate your use of this site if you violate any of these prohibited uses. Webmaster Referral (2nd tier):
Affiliates are allowed ONE account per household, office, location or IP. You can not refer yourself or immediate family members. Accounts with duplicate information will be deleted. Multiple accounts will not be accepted and shall be deleted from our system. Affiliates may not log into their referred affiliates accounts for any reason. Any fees earned for multiple accounts will not be paid and all fees previously paid will be deducted from future earnings.

Refunded Transactions:
Transactions that are refunded will be deducted from the affiliates account. 

User Information. When you register (for an account or other information) regardless of reason for the Web Site, you will be asked to provide Cyber Junky, Inc. with certain information including, without limitation, a valid email address (your "Information"). In addition to the terms and conditions that may be set forth in any privacy policy on this Web Site, you understand and agree that Cyber Junky, Inc. may disclose to third parties, on an anonymous basis, certain aggregate information contained in your registration application. Services to be Provided. We agree to pay you certain commissions as described on our website for referral sales made by customers. Your payments are completely contingent on all third party billing companies (credit card companies) paying us first. If a third party billing company was to hold our funds, we would not payout on those sales until we were paid from the third party billing company.

Termination. We may terminate your account:

YOUR SERVICE WILL BE TERMINATED IMMEDIATELY, WITHOUT WARNING AND WITHOUT PAY FOR COPYING ALL OR PART OF OUR SITES, FOR ANY UN-AUTHORIZED REASON. You may also be subject to fines and legal actions as a result of any type of copyright infringement.

YOUR SERVICE WILL BE TERMINATED IMMEDIATELY, WITHOUT WARNING AND WITHOUT PAY SHOULD YOU USE OUR SYSTEM AS PART OF ANY BULK EMAIL CAMPAIGN (SPAM). You may also be subject to fines and legal actions as a result of your bulk email promotion.

Affiliates from the Philippines have been banned from the Traffic Payouts Program. All accounts originating from the Philippines will be terminated immediately, without warning and without pay.

If we learn of a violation or likely violation of our TERMS OF SERVICE, we will attempt to notify you. If you do not take immediate remedial action which is satisfactory to us, or in the event of a serious violation of the TERMS OF SERVICE, we reserve the right to terminate your account immediately. Every effort will be made to re-establish your account upon receiving such representations from you as we deem appropriate in the circumstances.

Indemnity. You agree to defend, indemnify, and hold harmless Cyber Junky, Inc., its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Material or your breach of the terms of these Terms and Conditions. Cyber Junky, Inc. shall provide notice to you promptly of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit or proceeding.

Assignment. This agreement is personal to you. You may not assign your rights under this agreement without our prior written consent. If you do assign your rights, as would be the case were someone other than you to use your account, you shall remain liable to us for any fees due under this agreement. We may assign this agreement at any time.

Change of Terms and Conditions. We reserve the right to change the terms and conditions of this agreement as needed. Please check back here often to see if there have been any revisions. Use of our servers by you after said changes constitutes acceptance of those new terms and conditions. If you do not agree to the new terms and conditions, you may terminate this agreement. You shall only be paid for money earned prior to our notification of your termination.

Notification of Account Changes. You agree to provide us with such other information relating to your use of this service as we deem necessary or desirable. You agree to notify us if your address, email address, telephone number, billing information changes.

Notices. All notices, requests, demands, and other communications under this agreement shall be in writing and shall be deemed to have been given on the date of delivery: if delivered personally to the party to whom notice is to be given; if sent by electronic mail with a cc: to sender; if sent by fax; or on the third day after mailing by first class mail. For any disputes between you and Cyber Junky, Inc., you may contact us at support@cyberjunkyinc.com. Cyber Junky, Inc. will make every effort to resolve your dispute.

General Provisions. Cyber Junky, Inc. makes no claims that the Materials/Products may be lawfully viewed or downloaded in your jurisdiction. Access to the Materials may not be legal by certain persons or in certain countries. If you access these web sites, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. These Terms and Conditions are governed by the internal substantive laws of the State of California. Jurisdiction for any claims arising under this agreement shall lie exclusively with the courts within San Diego County, and all parties submit to the jurisdiction of the venue of these courts. If any provision of these Terms and Conditions are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in additional terms of use for areas of the Web Site, such as a particular "Legal Notice," or Software License or material on particular Web pages, these Terms and Conditions constitute the entire agreement between you and Cyber Junky, Inc. with respect to the use of Web Site. No changes to these Terms and Conditions shall be made except by a revised posting on this page.

General Contest Rules and Regulations

1. Eligibility:
A. Persons must be at least 18 years of age unless otherwise noted.
B. No purchase necessary to partake in the Traffic Payouts giveaway.
C. You must be an active affiliate of Traffic Payouts as determined at the discretion of Traffic Payouts
D. Contests are void where prohibited.
E. No prior employees or people that have been employed by Traffic Payouts within twelve (12) months are eligible.
F. Employees of Traffic Payouts, their advertising agencies, and/or immediate family members are not eligible to play or win.

2. Prizes and Taxes:
A. Values and prizes are subject to change without prior notice.
B. Prizes are non-refundable and non-transferable.
C. No substitutions are allowed unless otherwise noted.
D. Winners are responsible for any and all taxes / Import Duties / VAT, etc.
E. All federal, state and local laws apply to any contest on Traffic Payouts.
F. Anyone winning a single prize on Traffic Payouts or the accumulation of prizes that have a value greater than $600 will be subject to an I.R.S. 1099 and the applicable taxes.

3. Claiming Prizes:
A. All prize winners will be required to send in 3 photos of themselves with their prize, and to call into our phone recording system and leave a comment about winning their prize. The pictures and audio recording must be submitted to Traffic Payouts within 7 days of receiving their prize in the mail or they will be disqualified from winning any future prizes.
B. All recipients of prizes must agree to have their photos and audio used on Traffic Payouts.
C. All prizes are to be mailed inside the US.
D. Some non-US residents will get the cash equivalent, at the sole discretion of Traffic Payouts.
E. Traffic Payouts management will have the sole right to determine a "unique situation."
F. Traffic Payouts is not liable for any damages, errors, or unforeseen circumstances surround the prize or transfer thereof.
G. Traffic Payouts is not liable for replacing a prize that is lost, stolen, or defective. You must contact the vendor directly.

4. Disqualification:
A. Anyone thought to be cheating or abusing the system will be permanently disqualified from all contests both present and future.
B. Traffic Payouts reserves the right to disqualify any participant at its sole discretion.
C. The decision to disqualify a participant is final, and not open to debate. If you try and cheat the system you will be banned!

5. Clause:
A. Traffic Payouts is not held liable in the event of any legal problems.
B. All decisions made by Traffic Payouts management are final. Your participation in the contest is contingent upon your agreement to these terms.
